Liability Waiver & Photo/Media Release

Please read this agreement carefully. A parent or legal guardian accepts these terms during registration on behalf of each enrolled student.

This agreement is accepted electronically per student in the enrollment portal during that student’s onboarding — recorded with a checkbox, the guardian’s typed-name signature, and the date. The photo/media portion below is now chosen separately per student in the Photo & Media Release, and emergency care in the Emergency Medical Authorization.

In this agreement, “the Academy” refers to Mustard Seed Music and Arts Academy, together with its owners, instructors, staff, and volunteers. “Participant” means the enrolled student, and “I” / “we” refers to the parent or legal guardian accepting this agreement.

1. Assumption of risk

I understand that participation in music, art, performing arts, movement, drumming, sewing, and related creative activities involves inherent risks — including, but not limited to, physical activity and movement, the use of instruments, tools, art materials, needles, sewing machines, and other equipment, and ordinary risks of being present at the Academy’s facility. I voluntarily enroll the Participant with full knowledge of these risks and accept them on the Participant’s behalf.

2. Release of liability

To the fullest extent permitted by Michigan law, I, on behalf of myself, the Participant, and our heirs and family, release and hold harmless the Academy from any and all claims, demands, or causes of action for injury, loss, or damage to person or property arising out of or connected to the Participant’s participation in classes, workshops, events, or presence at the facility, except where caused by the Academy’s gross negligence or willful misconduct. I agree that the Participant will follow the reasonable safety instructions of instructors and staff.

3. Health & emergency care

I confirm the Participant is in adequate health to take part in the activities of the class(es) enrolled. In the event of injury or a medical emergency where I cannot be reached, I authorize the Academy to seek appropriate emergency medical care for the Participant. I understand I am responsible for any resulting medical costs. It is my responsibility to inform the Academy of any allergies, medical conditions, or special needs relevant to safe participation.

4. Photo & media release

I understand the Academy may photograph, video-record, or audio-record classes, performances, and events. I grant the Academy permission to use images, video, audio, and likeness of the Participant for the Academy’s promotional and educational purposes — including its website, social media, printed materials, and newsletters — without compensation. No last names or personal contact information will be published alongside a Participant’s image without separate consent.

Opting out: If you prefer that your Participant not appear in Academy media, you may decline this release during registration or notify us in writing at any time at Mustardseedartacademy@gmail.com. Declining the media release does not affect enrollment.

5. Behavior & removal

I understand that the Academy provides group classes for children and adults and that a respectful, safe environment is essential. The Academy may ask a Participant to step away from an activity, or to withdraw from a class, if behavior repeatedly disrupts the group or endangers others. Any such situation is handled under the Enrollment, Payment & Credit Policy.

6. Agreement

I confirm that I am the parent or legal guardian of the Participant, that I have the authority to accept this agreement on the Participant’s behalf, and that I do so voluntarily. This agreement is governed by the laws of the State of Michigan.
